Una crítica al marco anti-trata del Consejo de Seguridad
Resum
El artículo analiza el tratamiento de la categoría de vulnerabilidad en la trata de personas relacionada con conflictos armados (TPRCA) por parte del Consejo de Seguridad de las Naciones Unidas (CSNU). El estudio se centra en el marco de las dos principales resoluciones anti-trata del CSNU: las resoluciones S/RES/2331 y S/RES/2388. Se argumenta que el tratamiento de la vulnerabilidad en dichas resoluciones presenta dos problemáticas interrelacionadas. En primer lugar, adoptan un enfoque restrictivo respecto a los indicadores de desigualdad que actúan como factores de riesgo para la victimización por TPRCA. En segundo lugar, reproducen un modelo victimológico limitado, que no logra captar adecuadamente la complejidad de los perfiles de riesgo ni reconocer plenamente la capacidad de agencia de las víctimas o de las personas en situación de riesgo. Se concluye que, a pesar de ciertos progresos, el marco anti-trata del CSNU tiende a reproducir modelos hegemónicos de comprensión de la trata de personas, lo que limita el desarrollo de enfoques más holísticos e integrales que permitan abordar sus factores y dinámicas de manera más compleja.
