Vulnerabilitat, tràfic de persones i conflictes armats. Una crítica al marc regulador del Consell de Seguretat
Una crítica al marco anti-trata del Consejo de Seguridad
Resum
L’article analitza el tractament de la categoria de vulnerabilitat en la tracta de persones relacionada amb conflictes armats (TPRCA) per part del Consell de Seguretat de les Nacions Unides (CSNU). L’estudi se centra en el marc de les dues principals resolucions anti‑trata del CSNU: les resolucions S/RES/2331 i S/RES/2388. S’argumenta que el tractament de la vulnerabilitat en aquestes resolucions presenta dues problemàtiques interrelacionades. En primer lloc, adopten un enfocament restrictiu respecte als indicadors de desigualtat que actuen com a factors de risc per a la victimització per TPRCA. En segon lloc, reprodueixen un model victimològic limitat, que no aconsegueix captar adequadament la complexitat dels perfils de risc ni reconèixer plenament la capacitat d’agència de les víctimes o de les persones en situació de risc. Es conclou que, malgrat certs progressos, el marc anti‑trata del CSNU tendeix a reproduir models hegemònics de comprensió de la tracta de persones, cosa que limita el desenvolupament d’enfocaments més holístics i integrals que permetin abordar els seus factors i dinàmiques d’una manera més complexa.
